Terms of service

1- Purpose and Acceptance of the General Terms and Conditions of Sale

Barbara Gould welcomes you to its website, available at the following URL: www.barbaragould.com

The Barbara Gould website (hereinafter the "Site"), published by LAP Groupe (S.A.S. with share capital of €8,268,008.81, 33 avenue de Wagram, 75017 PARIS, RCS 899 219 208, tel. +33 1 41 44 77 30, hereinafter the "Seller"), offers cosmetic products for sale to consumers in mainland France. For the purposes of these terms, a consumer who has confirmed an order shall be referred to as the "Buyer".

The contractual language used by Barbara Gould is French.

These General Terms and Conditions of Sale may be saved or printed, provided that they are not modified.

These General Terms and Conditions of Sale are valid from 1 September 2026.

The Seller reserves the right to amend these General and Specific Terms and Conditions of Sale at any time and without notice, it being understood that such amendments shall not apply to reservations and orders previously accepted and confirmed by the Buyer.

2- Products Sold on the Site and Offers

Before placing an order, the Buyer may consult on the Barbara Gould Site the essential characteristics of the product(s) they wish to order.

Purchase offers are valid for as long as they are displayed on the Site.

Promotional offers cannot be combined.
Single-use masks are excluded from current promotional offers, unless explicitly stated otherwise on the Site.

3- Product Prices

Prices shown on this Site are in euros including all taxes, excluding shipping costs, for deliveries in mainland France. They may vary during the year, it being understood that products ordered are invoiced at the prices in force at the time of the order.

The "My Basket" section and the order summary specify the packaging and shipping costs payable by the Customer in addition to the price of the products.

Prices include the value added tax (VAT) applicable on the day of the order, and any change in the applicable rate will be automatically reflected in the price of products sold by the Seller on its Site.

4- Orders

Where the Customer is a natural person, the Customer declares that they are at least 18 years old and have legal capacity, or hold parental authorisation allowing them to place an order on the Site. The Customer guarantees that the information they provide when making a purchase is true and accurate.

To buy Barbara Gould Products, you must select the product in the Site catalogue by clicking on it, open a customer account in the "My Account" section and complete the form in the "My Basket" section (mandatory fields are marked with an asterisk). Please read the summary then displayed on screen carefully before confirming your order and proceeding to online payment. The sale of Barbara Gould Products is definitively concluded upon payment of the order; until then, you may cancel the order in progress or correct any errors.

The order may be printed. The Seller recommends that the Buyer keep the information contained in the order confirmation sent by the Seller on paper or in electronic form.

As soon as the order is registered, a detailed acknowledgement of receipt will be sent to the Buyer at the email address they have provided.

This acknowledgement of receipt states the exact amount invoiced and the delivery terms of the order. Please keep it to make it easier to track your order.

5- Payment

All orders are payable in euros.

To pay for their order, the Buyer may use the following payment methods: Visa or Mastercard bank cards, or a PayPal account.

The Buyer guarantees to the Seller that they hold any authorisations required to use the payment method chosen when registering the order form.

Payment is handled by a platform external to Barbara Gould, managed and secured, depending on the Buyer's choice, either by PayPal (PayPal (Europe) S.à r.l. et Cie, S.C.A., RCS Luxembourg B 118 349, 22-24 Boulevard Royal, L-2449 Luxembourg) or by 3D SECURE / BNP PARIBAS (Société Anonyme with share capital of €2,492,414,944, RCS Paris no. 662 042 449, Orias no. 07 022 735, EC identifier FR76662042449, 16 bd des Italiens - 75009 Paris).

6- Delivery

Orders are processed and dispatched on working days (Monday to Friday, excluding public holidays). Delivery will take place within an average of 3 days of receipt of the order form, and within a maximum of 30 days of receipt of the order form.

In mainland France, Monaco and Corsica, delivery is made by Colissimo Domicile Signature to the delivery address specified by the Buyer when ordering. With Colissimo Expert delivery, orders are usually delivered within 2 working days of dispatch; this may extend to 8 working days during busy periods.

If Barbara Gould exceptionally accepts an order from abroad, delivery is made by Chrono Classic and only to the following countries: Belgium, Netherlands, Luxembourg, Italy, Spain, Portugal, Austria. With Chrono Classic delivery, orders are usually delivered within 4 to 5 working days of dispatch.

Please note that the French overseas departments and territories are customs territories separate from mainland France, to which Barbara Gould does not deliver. The same applies to countries outside the European Union. A Buyer who nevertheless arranges delivery to these territories accepts the risk of being liable for significant customs duties and taxes, the amount of which cannot be calculated in advance.

Delivery times depend on the delivery zone and may take up to 2 extra days, excluding any customs checks.

Delivery charges apply to each parcel sent. An order can only be linked to a single postal address. If you wish to send the same parcel to several addresses, you will need to place a separate order for each address.

The Buyer is responsible for any incorrect or missing information in the delivery address and in their identity details, as Barbara Gould cannot physically verify this information.

We recommend that you check the number, references and condition of the Barbara Gould Products on receipt, in the presence of the carrier or postal worker, and note any reservations on the delivery or handover slip. If it is not possible to check the Barbara Gould Products in the presence of the carrier or postal worker, we recommend that you write "subject to reservations" on any delivery or handover slips you are asked to sign when your order is delivered, and then, upon delivery, unpack and carefully check the condition and conformity of the Barbara Gould Products. We recommend that you inform us in writing of any defect or non-conformity as soon as you receive the parcels. If a defect appears to be attributable to the postal services, we advise you to file a claim with your post office and send us a copy.

The contact details to which any after-sales requests and complaints may be sent are set out in Article 9.2.

7- Consumer Information on Applicable Guarantees - Order of 18.12.2014

The seller is liable for:

1. any lack of conformity of the goods with the contract, under the conditions of Article L. 217-4 et seq. of the French Consumer Code, and

2. any hidden defects in the goods sold, under the conditions set out in Articles 1641 et seq. of the French Civil Code

When acting under the legal guarantee of conformity, the consumer:

has two years from delivery of the goods to take action;

may choose between repair or replacement of the goods, subject to the cost conditions set out in Article L. 217-9 of the French Consumer Code;

is not required to prove the existence of the lack of conformity during the six months following delivery of the goods. This period was extended to twenty-four months from 18 March 2016, except for second-hand goods.

The legal guarantee of conformity applies independently of any commercial guarantee that may be granted.

If the consumer decides to invoke the legal guarantee against hidden defects in the goods sold, they may choose between cancellation of the sale or a reduction in the sale price, in accordance with Article 1644 of the French Civil Code.

Article L. 217-9 of the French Consumer Code: "In the event of a lack of conformity, the buyer chooses between repair and replacement of the goods. The seller may decline to proceed as chosen by the buyer if that choice entails a manifestly disproportionate cost compared with the other option, taking into account the value of the goods or the significance of the defect. The seller must then, unless impossible, proceed with the option not chosen by the buyer."

Article L. 217-10 of the French Consumer Code: "If repair and replacement of the goods are impossible, the buyer may return the goods and have the price refunded, or keep the goods and have part of the price refunded.

The same option is available to the buyer:

1° If the solution requested, proposed or agreed in application of Article L. 217-9 cannot be implemented within one month of the buyer's complaint;

2° Or if that solution cannot be implemented without major inconvenience to the buyer, given the nature of the goods and the use sought.

However, the sale cannot be cancelled if the lack of conformity is minor."

In the event of non-conformity of the product, in particular due to a defect or an error in the references delivered:

  • the Seller will send the replacement product at its own expense, provided that the Buyer first returns the product to the Seller in the condition in which the Buyer received it.
  • the Buyer may choose to return the product to the Seller and obtain a refund, which will be made within a maximum of 30 days of the Buyer's request.

The cost of returning a non-conforming product will be refunded by the Seller.

Requests under the legal guarantee of conformity or the guarantee against defects in the goods sold must be sent to:

Email: contact@barbaragould.com.
